Does anyone know of America Service Co-affiliated with Wells Fargo?

We are currently running and our house is set for auction May 22 – also the declaration of bankruptcy. We have been receiving messages recently been barely audible as we can tell is Wells Fargo. I looked Google the number and I can say the number is America Service Co. and are affiliated with Wells Fargo, we have our mortgage. We try to make loan few months and denied amendment, as expected. From what I read about ASC are brain dead and I imagine that dealing with short sales. Unpleasant sound and called me twice in one day. Does anyone know anything about them and I give them a call?

Sorry to hear you're spending so much! Be careful, there is much to get rich schemes happening right now, especially with mortgages. Go ahead and call the number and remember you do not have to work with anyone. See what they have to offer. If you are in bankruptcy, then there may be a creditor calling you. short sale need to be discussed with your lender, not you. (When lenders agree to do a short sale in real time property, means the lender is accepting less than the total amount due.)

After the foreclosure sale?

A friend of mine is in foreclosure. Your house is going to sheriff sale July 10. An agent real estate in the area have spoken to them and told them to do something I've never heard of. According to the estate, the Bank is the corp. Buying the house sheriff's auction. (I've always thought that anyone could make an offer on the house of those). Apparently, the bank will buy the house back in less than what you owe. Thus, on the bank of "books" the amount owed is now less. The realtor also said that since our state is 6 months period redemption, my friend will own your home during that time. The realtor said they should turn around and sell your home … and anything made for the amount the bank paid for sale is my friend money. Example: Suzy owes $ 100 000 at home. The bank buys the house at sheriff's sale of $ 50k. Suzy and realtor sell house for $ 70k. Suzy makes a profit 20k. Is this true??

That does not sound right. The bank will take possession after the auction if no one buys it. Usually amortization periods refer to the amount of time a person must exercise his debts and regain the house. Ex owes $ 100,000 to win $ 150,000 in lottery next month. You can pay the bank the $ 100K + penalties and get your house back. This remains true even if someone buys at auction.

Law trial deficiency?

Maine foreclosure law: deficiency judgments are limited by the fair market value of goods sold in foreclosure as determined by appraisal. Therefore (for the sake of round numbers), say that my house has a balance of payment of 200,000 dollars. The assessment of the value of the property is $ 160,000. The bank forecloses on the home and the home is sold at auction for $ 140,000. By Maine law (quoted above) is the deficiency of the sentence will be $ 20,000 (difference between sales and the market price) or $ 60,000 (difference between sale price and balance of payment). @ Mike – If the bank goes after the deficiency of how that works? If I have to forgive the deficiency claim $ 60,000 in income or is still limited to the market price the house. Thank you.

$ 20k – the difference between the sale price and fair market value. In a case like this, I would do everything possible for the appraiser to see a house of poor quality, worthless! – Stuart
