Bankruptcy?
I am a resident of New Jersey, and I own a house that is valued at $ 320,000. I have a $ 240,000 mortgage and a lien court of $ 60,000 in the house. They are forcing a foreclosure by judicial seizure and somehow I get rid of the garment. Should bankrupt. Not sure if Chapter 7 will help, because the judiciary is yet to claim insurance. Also, not sure whether Chapter 13 will help, because I have to pay $ 60,000 and maximum possible payment plan is 5 years and therefore will pay $ 1000 per month. Anyway all this? Am I allowed pay less than $ 60,000 if you file chapter 13? Can I remove the lien in Chapter 7? Any help is greatly appreciated. Thank you.
I agree only Ray and Carl, you should contact an attorney who handles bankruptcy in New Jersey. http://www.nacba.org/attorneyfinder/search.php?l=nj bankruptcy should be the last action to stop the foreclosure to take place. Depending on the time in establishing the foreclosure, you may want to try to refinance your home to pay off the lien, you have enough equity in the house. http://www.nywb http://www.njb.uscourts.gov/chambers2/burns/04gb001p_00-15864_03-13458_James-Allen.pdf http://www.assetprotectionbook.com/NJ_Schick_2004.htm. uscourts.gov/decisions/jcn/42_In_re_EVAUL.pdf
